ANZ Captain America: Brave New World Competition (“Competition”) Terms and Conditions (“Terms and Conditions”)

 

1. Information on how to enter the Competition and the prizes under the Competition form part of these Terms and Conditions. By participating in the Competition (including by accepting a prize), a person is taken to have accepted, and to have agreed to be bound by these Terms and Conditions.

2. The “Promoter” is Australia and New Zealand Banking Group Limited (“ANZ”) (ABN 11 005 357 522) 833 Collins Street, Docklands VIC 3008.

3. The Competition commences at 12.01am AEDT on Friday 24 January 2025 and closes at 11.59pm AEDT on Friday 28 February 2025 (“Promotion Period”).

4. Subject to clauses 5 and 6 below, entry is open to Australian residents who:

(a) are 18 years of age or older at the time of entering the competition; and

(b) are an ANZ Customer during the Promotion Period; and

(c) are not, an employee, contractor, board member or executive management committee member (or a member of the immediate family of such an individual) of the Promoter or an entity associated with conducting the Competition, or a subsidiary or related entity of the Promoter or an entity associated with conducting the Competition at any time from when the Competition commences until the Prize (as defined in clause 14) is accepted (inclusive); and

(d) must be available to accept the “Prize” (as defined in clause 14), in its entirety (including within the dates outlined in clause 14 of these Terms & Conditions). If the drawn entrant is unable to accept the Prize they will be considered ineligible & the Prize will be forfeited in its entirety, and a new Eligible Entry will be drawn.

5. For the purpose of clause 4(b), “ANZ Customer” means a person that ANZ can reasonably determine based on the information provided in the Eligible Entry, subject to clause 7, as having an active ANZ account. Excludes insurance products and accounts that are overdrawn, blocked, suspended, in default or otherwise in breach of the relevant terms and conditions.

6. For the purposes of clause 4(c), “immediate family” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

7. To enter the Competition, Eligible Entrants must during the Promotion Period log on to www.HOYTS.com.au/anz-circle-at-hoyts, and complete & submit the entry form (including an acknowledgment that they are an ANZ customer, their first name, last name, the email address registered to an ANZ account and mobile number) (“Eligible Entry”).

A maximum of one Eligible Entry per Eligible Entrant is permitted.

 

8. The Promoter reserves the right, at any time, to verify the eligibility and validity of entries and entrants (including an entrant’s identity, age, place of residence and other eligibility to ensure entrants are compliant with these Terms and Conditions) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe is ineligible for the Competition or has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

9. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

10. The draw for the competition winner will take place at 10.00am AEDT on Friday 7 March 2025 at Hoyts, level 7, 600 Church St, Richmond 3121. The Promoter will then verify the eligibility and validity of the drawn Eligible Entrant. The winner will be notified by phone and in writing (relying on the details provided in the winner’s entry) by Tuesday 11 March 2025. The first initial and surname of the winner will also be published online from Friday 14 March 2025 at HOYTS.com.au/competitions/ANZ-CircleCaptainAmerica from the notification date, subject to clause 30, for a minimum of thirty (30) days. The postcode of the winner who is a South Australian resident will also be published online unless that winner requests otherwise. The Promoter shall not be held liable for any failure to notify the winner resulting from the provision of inaccurate or incomplete information at the time of entry.

11. There will be one (1) draw and one (1) Prize winner (“Winner”).

12. The Promoter may draw additional Eligible Entries (“Reserve Entries”) and record them in order in case an invalid entry or ineligible entrant is drawn or the Prize remains unclaimed or forfeited.

13. The Promoter’s decision is final and no correspondence will be entered into.

14. The first Eligible Entry drawn from all Eligible Entries received will receive the Prize as described below:

  • Return economy flights for two (2) adults from the Winner’s nearest Australian capital city to Mexico City International Airport, Mexico (flight associated taxes are included).
  • Five (5) nights’ accommodation based on one double occupancy room for two adults in a four (4) star hotel (Property selected by the Promoter).
  • A private 5-hour Mexico City guided walking tour with a professional guide, including museum entrance tickets.
  • Virtual reality park experience.
  • Spy-themed escape room experience.
  • Observation deck tickets in one of Mexico City’s famous skyscrapers (as selected by the Promoter).
  • Dinner at a rooftop restaurant with incredible city skyline views (as selected by the Promoter).
  • Travel insurance allowance of $121 AUD per adult.

 

(the “Prize”)

15. The Winner and their companion must be 18 years of age or over.

16. The Winner and their companion are responsible for transport to and from their residence to the airport.

17. The maximum retail prize value of the Prize is up to $13,233 AUD (including GST, if any) depending on the point of departure. Values are correct as at Thursday 12 December 2024. The Promoter accepts no responsibility for any variation in the value of the Prize.

18. Unless otherwise stated in clause 14, the Prize does not include meals, hotel car parking, additional spending money, transfer fees, passports, visas, telephone charges, transport to and from closest airport in Australia, items of a personal nature, in-room charges or any other ancillary costs. Other hotel incidentals (including without limitation in-house mini-bar, telephone, and laundry charges), private transportation to events and activities and transportation other than stated, travel or other insurance, or any other costs of a related, ancillary, personal or incidental nature are not included.

19. The Prize is subject to availability at the time of booking. The Winner and their companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the Prize. The Prize is subject to the standard terms and conditions of individual Prize provider(s) and their service providers. The Winner and their companion are responsible for ensuring that they have valid passports, and any requisite vaccinations and travel documentation. Compliance with any health or other government requirements, other travel documentation and any requirements of a personal nature are the responsibility of the Winner and their nominated companion.

Additionally;

  • Accommodation is based on two (2) people sharing one (1) room.
  • A valid credit card may be required at the hotel check-in for incidentals.
  • Tickets are non-transferable and no name changes allowed. Once tickets are issued, they are non-endorsable and non-transferable. Any alterations to confirmed flights and/or accommodation details will be at the expense of the Winner. All components of the Prize must be fulfilled at the same time and they cannot be split across different time periods.
  • Any changes by the Winner made to the specified Prize package (including travel extensions, additional guests, etc.) will be subject to an administration fee of AU$250 excluding GST, which must be settled in full prior to booking confirmation.
  • Individual supplier terms and conditions apply. Once the Prize has been arranged, any changes to the travel, flights, accommodation, or scheduling arrangements are at the expense of the Winner and their travelling companion.
  • Flights are economy class and may be indirect. The airline’s Conditions of Carriage apply to all flights. Flight route and dates of travel are subject to the promoter’s absolute and final decision.
  • Winner must obtain their own travel insurance and proof of insurance be provided before tickets are issued.

20. If any non-cash prize (or part of any non-cash prize) is unavailable, subject to any written directions from a regulatory authority, the Promoter, in its discretion, reserves the right to substitute the non-cash prize (or that part of the non-cash prize) with a prize to the equal value and/or specification.

21. Travel dates must be confirmed by the Winner within 45 days of notification. The Winner must provide the Promotor with details of their nominated companion’s name by 5.00 pm AEDT 9 April 2025 and acknowledge that such details cannot be amended thereafter.

22. All flights are non-changeable. Subject to the terms and conditions of the participating prize provider(s) and their service providers, and subject to the unclaimed Prize draw clause, if for any reason the Winner does not, once the Prize has been booked, take the Prize (or an element of the Prize) at the time stipulated, then the Prize (or that element of the Prize) will be forfeited and will not be redeemable for cash.

23. The Prize is subject to the individual supplier terms and conditions, including any applicable age restriction. The Promoter and Prize suppliers hereby expressly reserve the right to eject the Winner (and/or his/her/their companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the Prize.

24. The Prize, or any unused portion of the Prize, are not exchangeable, transferable, refundable, and non-cash prizes are not redeemable for cash.

25. Tax implications may arise from the Prize winnings. Independent advice should be sought.

26. The Promoter reserves the right to run a Prize redraw in the event of an entrant forfeiting or not claiming a prize. For any Prize that remains unclaimed or forfeited as at 10.00am AEDT on Tuesday 10 June 2025, subject to any applicable law, HOYTS will conduct a further draw on Tuesday 17 June 2025 at the same time and place as the original draw. The Promoter will then verify the eligibility and validity of the drawn Eligible Entrant. The Winner, if any, will be notified by email by HOYTS (relying on the details provided in the Winner’s entry) on Thursday 19 June 2025, and their first initial and surname will be published online at HOYTS.com.au/competitions/ANZ-CircleCaptainAmerica from Tuesday 24 June 2025, subject to clause 30, for a minimum of 30 days. The postcode of any Winner who is a South Australian resident will also be published online unless that winner requests otherwise. The Promoter shall not be held liable for any failure to notify the Winner of the redraw resulting from the provision of inaccurate or incomplete information at the time of entry.

27. As a condition of accepting the Prize:

(a) the Winner of the Prize must remain an ANZ customer for the duration of the Prize or until it is otherwise fully taken; and

(b) the Winner (and his/her/their companion) must sign any legal documentation as and in the form required by the Promoter and/or Prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. If the Winner’s companion is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.

28. If the Winner does not accept the Prize in accordance with this clause, they will be deemed to have forfeited the Prize.

29. If the Winner forfeits the Prize or notifies the Promoter that they do not wish to accept the Prize, the publication of the Winner’s name as outlined in clauses 10 and 26 will be removed within 24 hours of such forfeiture or notification.

30. Entrants consent to the Promoter and The HOYTS Corporation Pty Ltd ABN 31 006 082 551 (‘HOYTS’) using their name, likeness, image and/or voice if they accept the Prize (film, recording and/or and photographs of the same) in any media without remuneration for the purpose of promoting this Competition (including any outcome), and any or future promotional, marketing and publicity purposes.

31. HOYTS will collect personal information and may use this personal information for assessing and processing your entry into and conducting the Competition and any purpose which is required or authorised by law, regulations and codes of practice and may, for this purpose, disclose such personal information to the Promoter and third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to parties we are authorised or required by law or court/tribunal order to disclose information to. Entry into the Competition is conditional on providing this personal information.

32. The Promoter and HOYTS may collect or process this information from you directly or through service providers who collect your personal information on behalf of the Promoter and HOYTS.

33. For more information about how the Promoter and HOYTS will each use and handle your personal information please refer to: (a) for the Promoter, its privacy policy which can be viewed at https://www.anz.com.au/privacy/centre/policy/; and (b) for HOYTS, its privacy policy which can be viewed at https://www.hoyts.com.au/privacy-policy. The Promoter’s privacy policy and HOYTS’ privacy policy, also contain information about how entrants may update their marketing preferences, access, update or correct their personal information held by the Promoter or HOYTS (as applicable), how entrants may complain about a breach of the Australian Privacy Principles by the relevant entity or any other applicable law and how those complaints will be dealt with.

34. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law, to acting reasonably:

(a) disqualify any entrant; or

(b) subject to any written directions from a regulatory authority, modify, suspend, terminate or cancel the Competition, as appropriate.

35. The Winner and companion travel at their own risk and in the event of war, terrorism, state of emergency, government lockdown, pandemic, or any other kind of disaster or unforeseeable event beyond the Promoter’s reasonable control, the Promoter reserves the right to cancel, terminate, modify or suspend the Competition or suspend, substitute or modify the Prize, subject to any written directions from a relevant regulatory authority.

36. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the internet service provider used.

37. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investments Commission Act 2001 (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).

38. Except for any liability that cannot by law be excluded or modified by agreement, including the Non-Excludable Guarantees, each of the Promoter and HOYTS (including its respective officers, employees and agents):

(a) makes no warranties or representations and expressly disclaims any and all liabilities (including for consequential damages) to the type, quality standard, or fitness or suitability for any purpose of all or part of the Prize;

(b) is not responsible for any technical difficulties or equipment malfunction (due to any reason beyond the reasonable control of the Promoter or HOYTS);

(c) is not responsible for the loss, theft or destruction of all or part of a Prize or the loss or theft of a cash prize;

(d) is not responsible for any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter or HOYTS, as applicable) due to any reason beyond the reasonable control of the Promoter;

(e) is not responsible for any variation in the value of non-cash prizes to that stated in these Terms and Conditions;

(f) is not responsible if any of the events for the Prize is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter;

(g) is not responsible for any tax liability incurred by a winner or entrant; or

(h) does not accept any liability for any personal injury, loss or damage arising from the acceptance, use or misuse of any prize, or the failure to claim or use the Prize.
