     TERMS AND CONDITIONS

     

    1. Information on how to enter and the prize(s) forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

    2. Entry is only open to Australian residents aged 18 years or over, or with the permission of a parent/guardian. Parents/guardians may be required to enter into a further agreement as evidence of consent to the terms of this promotion.

    3. Employees (and their immediate families) of the Promoter, participating HOYTS Cinemas and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

    4. Promotion commences at 12:01am AEST on Saturday 5 August 2023 and ends at 23:59pm AEST on Sunday September 10 2023 for ticket purchases. Final entries close at 23:59pm AEST on Tuesday 12 September 2023 (“Promotional Period”). 

    5. To be eligible to enter, eligible individuals must, during the Promotional Period, complete the following steps:

    • Purchase at least one (1) movie ticket for Gran Turismo: Based on a True Story to a HOYTS D-BOX session online at hoyts.com.au or via the HOYTS app or in a HOYTS cinema.
    • For clarity the [1] movie ticket can be purchased throughout the whole Promotional Period for ticket purchases. Complimentary, free or refunded tickets will not be counted as ticket purchases.
    • You must be a HOYTS Rewards member and log in with your membership online at hoyts.com.au or via the HOYTS app or present your membership card in cinema when purchasing your [1] movie ticket.
    • Visit www.hoyts.com.au/competitions and follow the prompts to the promotion entry page; and fully complete and submit the online entry form with your personal details and booking/ticket reference numbers. You must include your first name, last name, email address, mobile number, and State/Territory of residence, booking or ticket reference numbers, HOYTS Rewards membership number and provide an answer to the question: "What is your favourite Gran Turismo Game and why?” (“Promotional Response”).
    • Incorrect or false entry information will void entry into the competition.

    6. Limit on entries:

    • Only one (1) entry per HOYTS Rewards member is permitted.

    Winning Method: Judging

    Prize Conditions: No part of either prize may be extended, transferred, exchangeable, redeemable for any other prize or transferable. If the prize winner is under 18 years of age, consent of their parent or legal guardian is required prior to the prize being awarded.

     

    7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

    8. Incomplete or indecipherable entries will be deemed invalid.

    9. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

    10. Entrants must retain their purchase receipt(s)/reference number(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of all of an entrant’s entries and forfeiture of any right to a prize.

    11. One (1) winner will be determined by representatives of The HOYTS Corporation, Level 50, 680 George Street, Sydney, NSW 2000 on Wednesday 13 September 2023. Each entry will be judged based on the individual creative merit of the answer to the Promotional Response. The best valid entries, as determined by the judges, will win the prizes specified above. The judges will select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry, ineligible entrant, non-contactable entrant or unclaimed prize. The winner will be determined by skill. Chance plays no part in determining the winner. The judges' decision is final, and binding and no correspondence will be entered into. The Winner will be contacted via email by Tuesday 19 September 2023.

    12. If for any reason a winner does not claim the prize (or an element of the prize) by 23:59pm AEST on Tuesday 26 September 2023, then the prize (or that element of the prize) will be forfeited. An alternative winner will be notified by email.

    13. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

    14. In case of an invalid entry, ineligible entrant, non-contactable entrant or unclaimed prize, the judges will select an additional reserve entry which they determine to be the next best and record them in order. An alternative winner will be determined by the representatives of The HOYTS Corporation, Level 50, 680 George Street, Sydney, NSW 2000 on Wednesday 13 September 2023 at the same time and place as the original judging. In the case of a winner, they will be notified in writing within two (2) business days of the judging and will have a maximum of 4 weeks to claim the prize. The process will continue until the prize is claimed.

    15. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are the winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 

    16. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

    17. These Terms and Conditions may be varied by the Promoter at any time. The Promoter accepts no responsibility for and will not be liable because of any reliance placed on the Terms and Conditions before they were varied.

    18. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

    19. Nothing in these Terms and Conditions limits, excludes, or modifies or purports to limit, exclude or modify the statutory consumer guarantees, as well as any other implied warranties (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees, and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special, or consequential, arising in any way out of the promotion.

    Including arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any prizes that are damaged, delayed or lost in transit; (f) any tax liability incurred by a winner or entrant; or (g) use of a/the prize.

    If liability under these terms implied by legislation cannot be excluded, the liability of the Promoter and its related bodies corporate is limited to the re-supply of the relevant goods or services or paying the cost of replacing them.

    20. The Promoter may communicate or advertise this Promotion using Facebook. However, the Promotion is in no way sponsored, endorsed, or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook. Each entrant completely releases Facebook from any and all liability.

    21. As a condition of accepting the prize, the winner and if under 18 years of age their parent or legal guardian must sign any legal documentation as required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

    The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and as required, to regulatory authorities. Third parties to whom personal information is disclosed may be based overseas. Entry is conditional on providing this information. By entering the Promotion, entrants consent to the collection, storage and use of their personal information by the Promoter, the Promoter’s related bodies corporate and for the winner/s, Sony Interactive Entertainment Europe Limited. Participants entering the Promotion opt-in to receive promotional material from the Promoter, its related bodies corporate and expressly consent to the Promotor, its related bodies corporate collecting, using and disclosing their personal information for their promotional activities in accordance with the Promoter’s Privacy Policy available here  and the Sony Interactive Entertainment Europe Limited Policy available here. Entrants have the right to access their personal information as collected and stored by the Promoter and the Promoter’s related bodies corporate at any time, and to request the correction of such information. All entries become the property of the Promoter. All personal information will be treated in accordance with the Privacy Act 1988 (Cth).
