HOYTS Rewards - Terms & Conditions

1. Program Overview

HOYTS Rewards (“HOYTS Rewards” or “Program”) is a loyalty program which is operated by The HOYTS Corporation Pty Limited ABN 31 006 082 551 (“HOYTS”). By enrolling and participating in the Program, you agree that you have read and understood these Terms and Conditions and are bound by them. You consent to HOYTS collecting, using, and disclosing your personal information in accordance with the HOYTS Privacy Policy available to view here.

HOYTS reserves the right to amend, alter, withdraw, or terminate the Program, any feature or benefit (“Benefits”) or the Terms and Conditions of the program at any time, subject to applicable law. Any such change may affect Benefits, which may have accumulated, as well as any future BenefitsBenefits of the Program are offered at the sole discretion of HOYTS.

 

2. Defined Terms

Activation Date: 

The commencement date for your HOYTS Rewards membership, also known as the Join Date. 

Anniversary: 

The date the HOYTS Rewards Membership started or the date which paid membership commenced. 

Benefit: 

Those features of the program that provide members with access to discounted movie tickets, discounts on food and drink items, Qantas Points and savings, which may change from time to time. 

HOYTS Points or Points 

The Program awards points, known as HOYTS Points (Points), for purchases made at HOYTS. Points are earned based on the dollar amount spent in a transaction when the HOYTS Rewards membership is included in the transaction. 

HOYTS Rewards / Program: 

The loyalty program which is operated by HOYTS and provides benefits to its members when they visit a HOYTS Cinema. 

Member, Members or Membership: 

A person who holds a current and active HOYTS Rewards membership. 

Participating Cinemas: 

A HOYTS Cinema that offers the HOYTS Rewards Program and the associated benefits which are listed at hoyts.com.au. 

Other Benefits: 

Other promotions and special Benefits which may be offered to you from time to time. 

Qantas: 

Qantas Airways Limited ABN 16 009 661 901. 

Qantas Points:  

Means Qantas Points awarded to Qantas Frequent Flyer Members. 

QFF: 

Qantas Frequent Flyer Program. Joining fees and conditions apply, see qantas.com/terms. 

QFF Account: 

Qantas Frequent Flyer account. 

QFF Member: 

A member of the Qantas Frequent Flyer Program. 

Reward: 

The meaning given to it in the Qantas Frequent Flyer Program Terms and Conditions. 

Reward Flight: 

The meaning given to it in the Qantas Frequent Flyer Program Terms and Conditions. 

Tier: 

The HOYTS Rewards tier selected by the member as part of their membership, which defines which benefits they are entitled to. 

 

3. Joining HOYTS Rewards

Customers can join the HOYTS Rewards program by completing the signup process in cinema, online at hoyts.com.au or via the HOYTS App and selecting a HOYTS Rewards Membership tier as listed below:

  • HOYTS Rewards Member tier is offered free of charge and provides immediate access to ticket offers including saving 10% on movie tickets including HOYTS LUX, $11.50 senior tickets, the ability to earn Points on all purchases excluding merchandise and access to complimentary popcorn refills.
  • HOYTS Rewards VIP tier is offered for $15 per annum and provides immediate access to ticket offers including saving 25% on movie tickets including HOYTS LUX, $10 senior tickets, saving 10% on food and drink purchases, the ability to earn Points on all purchases excluding merchandise and access to complimentary popcorn refills.

 Additional benefits for each tier are listed in clause 9 - Membership Benefits.

 

4. Participation in the Program

HOYTS Rewards Membership (Member) and Benefits are available at hoyts.com.au, via the HOYTS App or at participating HOYTS Cinemas listed on the HOYTS website (hoyts.com.au). HOYTS may vary the number of locations of HOYTS Cinemas that offer the Program (‘Participating Cinemas’) and shall notify Members of such changes via email.

Member may not gain Benefits from activities or purchases undertaken on behalf of a business. To participate in the Program, you must have a valid e-mail address and be 14 years of age or older. To access benefits for members 60+ years, a valid date of birth must be entered against the members profile and the age of the members must be 60 years or older to receive these benefits. HOYTS Rewards VIP Memberships are valid for 12 months and must be renewed annually, with payment of the applicable annual fee. Members who do not pay their renewal fee by the due date, will have their Membership automatically transferred to the HOYTS Rewards Member Tier, which does not have an annual fee and their Benefits will be changed to align with those of the HOYTS Rewards Member Tier.

HOYTS Rewards Membership and Benefits are not transferable, not redeemable for cash and are non-refundable. Membership can be revoked by HOYTS at any time, in its sole discretion and without compensation, for any reason including but not limited to abuse or breach of any of the Terms and Conditions of the Program, any actions deemed by HOYTS to be contrary to HOYTS, the Program or the interests of its Members or partners or in the case of fraud or misuse.

To the extent permitted by law, HOYTS assumes no liability whatsoever, for any expense, loss, cost, injury, damage, accident or any other matter however suffered or caused (including compensatory, incidental, indirect, special, punitive, consequential or exemplary damages or damages for loss of income or profits), directly or indirectly arising out of or related to the Program or by reason of the termination of or amendment to the Program in whole or in part, the value or availability of Benefits, or the addition or deletion of Benefits, reward partners or other features.

Neither HOYTS nor its respective officers, agents, employees and related bodies corporate shall be responsible for any failure of the hoyts.com.au or for any problems or technical malfunction of a telephone network or lines, computer online systems, servers, access providers, computer equipment, software, failure of any e-mail, online or Internet entry, technical problems, traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to any computer or property related to or resulting from participating in or downloading any material relating to the Program. HOYTS reserves the right, at its sole discretion, to cancel or suspend this Program should a virus, bug or any other cause beyond the reasonable control of HOYTS corrupt the security or proper administration of the Program.

Any attempt to deliberately damage any website or to undermine the legitimate operation of the Program may be a criminal offence and should such an attempt be made; HOYTS reserves the right to seek remedies and damages to the fullest extent permitted by law and lead to criminal prosecution.

 

5. Membership Enrolment and Activation

To enrol in the ProgramMembers must sign up to the HOYTS Rewards Member tier at a HOYTS cinema, online or via the HOYTS App, or purchase a HOYTS Rewards VIP Membership at a HOYTS Cinema, online or via the HOYTS App and pay the annual fee.

Members who purchase their Membership from a HOYTS Cinema may do so with a HOYTS Rewards Pack which includes a HOYTS Rewards membership card with a unique membership number. As part of the Membership account setup, customer will need to provide HOYTS staff with a valid email address and will have the option to provide a mobile number and date of birth.

Members must provide a valid email address when joining HOYTS Rewards. The email address will be used to log into a Members online account. HOYTS uses a passwordless two-factor authentication sign-in process. This proactive step aims to enhance cybersecurity by further safeguarding your personal details. HOYTS takes no responsibility for a Member’s failure to comply with these provisions. HOYTS Rewards Membership cards are not transferable and remain the property of HOYTS.

 

6. Renewing Membership

HOYTS Rewards VIP Membership has an annual fee of $15. Auto renewal is available online. If VIP member joined HOYTS Rewards in-cinema, they will need to opt-in to auto renewal via the HOYTS Website in the My Profile feature. 

VIP members will be notified via email, prior to their VIP membership expiring, that payment will be taken for another 12-month VIP membership.

Payment for VIP membership will be processed one week before expiry. If payment fails, an email will be sent to the member to advise that a second attempt to take payment will occur on a subsequent date. If second payment attempt fails, membership will then be downgraded to the HOYTS Rewards Member Tier and member will have access to the benefits in line with the Member Tier.

If membership is auto-renewed, members have the option to a refund within 14 days of renewal, provided none of the VIP benefits have been utilised/redeemed. Refunded VIP memberships will then be downgraded to the HOYTS Rewards Member Tier and member will have access to the benefits in line with the Member Tier.

To opt-out of auto renewals, log in to HOYTS Rewards account and uncheck the auto-renew check box on the My Profile page.

HOYTS Rewards members will have the ability to update/change their stored credit card via the My Profile page when logged into their account on the HOYTS Rewards website. Credit Cards are securely held by Braintree. HOYTS reserves the right to change providers at any time.

 

7. Membership Upgrades

Members can upgrade to a higher Tier at any time by selecting the upgrade option in the Account section of My Rewards and paying the applicable upgrade fee for the selected Tier. If you move to a higher Tier, the Tier change date will become your new Activation Date.

If a Membership is not used for a period of 2 years, HOYTS reserves the right to delete the account and the member will forfeit any accumulated Benefits within that account. For clarity, engaging with an account constitutes either:

  • Transactional activity such as including the Membership as part of purchasing tickets or redeeming Points
  • Upgrading Membership to a higher tier

 Membership fees are non-refundable or transferable and Members are not entitled to a refund if they move their Membership to a lower Tier, subject to compliance with Australian Consumer Law.

 

8. Marketing, Promotions and Personal Information

By enrolling in the ProgramMembers will be automatically enrolled into and consent to, receiving electronic messages and marketing communications from HOYTS, including but not limited to, the HOYTS Rewards e-newsletter, marketing and promotional material as well as other email and SMS communications containing session times, movie information, special offers about the Program and its rewards, services and third-party partner offers.  

HOYTS may contact you by text message, email or other digital service (such as through our applications that you install on your device such as a mobile or iPad), phone or post to let you know about our movie specials and promotions, any new or existing products or services, and those of our related companies and partners, that may be of interest to you. You can read more about our marketing practices in our Privacy Policy available to view here, including how to manage your marketing communications preferences. It is the responsibility of the member to set their own communication preferences by logging into My Rewards and selecting what they wish to receive and not receive or by selecting to opt-out of receiving email communications by selecting unsubscribe on the email footers. Members are responsible for keeping the information in their My Rewards account up to date including but not limited to their name, e-mail address, mobile phone number and date of birth.

 

9. Membership Benefits

Benefits are only available at participating HOYTS cinemas and may vary between Tiers. They cannot be redeemed in conjunction with any other promotional offers including, but not limited to, promotional discounted ticket, food and drink offers. Benefits are for personal use only and cannot be assigned, traded, or otherwise transferred without the prior written consent of HOYTS or otherwise in accordance with the Terms and Conditions of the Program. Any assignment or transfer in violation of these rules will be void and may, at the sole discretion of HOYTS, result in the loss of Membership or the cancellation of the affected Benefits or Account. 

Benefits available to Members as part of the program include:

  • Access to 10% or 25% Off Movie Tickets

Members on the HOYTS Rewards Member tier will receive 10% off the price of their movie tickets whentheir Membership Card Number is included in the ticket purchase transaction.

Members on the HOYTS Rewards VIP tier will receive 25% off the price of their movie tickets when the Membership Card Number is included in the ticket purchase transaction.

The ticket discount does not apply to special event tickets e.g., Girls Night Out, senior tickets for members aged 60+ ($10 for VIPs and $11.50 for Members), vouchers, 3rd party movie ticket offers, promotional movie tickets or already discounted tickets e.g., Family tickets, $10 Movie ticket.

 

  • 10% off Food and Drinks

Members on the HOYTS Rewards VIP tier will receive 10% off the price of food and beverage items purchased at HOYTS, including HOYTS LUX when they include their Membership card as part of the food and drink purchase. Members must have an active and valid Membership to receive this benefit.

Merchandise products such as plush toys, USB’s etc. are excluded from this offer. 10% off food and drinks is for personal use only and cannot be used for Group Bookings, parties, or corporate / private events / functions. HOYTS in its sole discretion reserves the right to refuse to supply this offer. Offer cannot be redeemed for cash back, credit or transferred and is redeemable as a reduction on the cost of purchased food and drink items only.

The offer is not available to members on the HOYTS Rewards Member tier.

 

  • Free Popcorn Refills

Members with an active and valid Membership are entitled to receive free popcorn refills on the same day as a popcorn is purchased either as part of a combo or as a standalone item and when a valid Membership card has been scanned as part of the original purchase and the same card is scanned as part of the free refill. To receive this benefit, Members need to return their empty popcorn container to a team member at the candy bar point of sale and request a popcorn refill from a team member at the counter and scan the same Membership card used as part of the original purchase. HOYTS will replace the empty popcorn container with a full one of a similar or same size. Free popcorn refills not available for HOYTS Gourmet Popcorn Range.

Members will not be required to return promotional containers but will need to present the promotional container when requesting the free refill. The refill will be supplied in a standard container of same / similar size and this container will need to be used for any additional refills on that day. Members will not be supplied with another promotional container as part of this offer. Used popcorn containers must be returned to HOYTS Staff when this benefit is being redeemed. Popcorn refills are provided under the HOYTS Fair Go policy where HOYTS reserves the right in its sole discretion to refuse to refill a Members popcorn where it is believed the benefit / offer is being abused and / or the refills are not for personal use or are being unreasonably shared with other groups / people. Free popcorn refills must be redeemed no later than 30 minutes after the last session of the day has commenced, where the offer is being redeemed. HOYTS reserves the right not to provide free popcorn refills after this time.

 

  • Birthday Reward

Members who have supplied a valid date of birth and added it to their Member profile in My Rewards and present their Membership card number at HOYTS on their birthday or within 30 days from their birthday, will receive a birthday reward on presentation of a registered physical Card, App virtual card and offer email. Offer must be redeemed in person by eligible Members only and in accordance with the directions given by HOYTS.

Birthday Rewards are supplied once per calendar year and once redeemed cannot be redeemed again for 12 months, even if a Member updates or alters their date of birth. Birthday rewards are applied automatically to a Members account on their stated birthday and will be valid for 30 days. Birthday reward includes a choice of either one (1) small popcorn or one (1) small post mix drink. Small Popcorn excludes HOYTS Gourmet Popcorn Range.   

Birthday Rewards cannot be redeemed for cash or credit, are not transferrable, cannot be backdated and cannot be extended. If the benefit is not redeemed within the specified time frame, it is forfeited. Photo identification may be requested prior to the Benefit being provided, to confirm identity and date of birth. If Membership starts on the Members birthday, the birthday Benefit cannot be redeemed until the next birthday.

HOYTS reserves the right not to provide this Benefit if it believes that the photo evidence is fraudulent, the person requesting the benefit is not the member, identification being presented is false, that the Benefit has already been provided within the past 12 months or in the event of system failure, closures or stock availability. In these instances, no compensation will be provided, subject to compliance with Australian Consumer Law.

 

  • Movie of The Week

Members will be able to purchase tickets to selected movies marked Movie of The Week at a discounted price, when a valid Membership card number is presented or is part of the ticket purchase. Pricing is only available for selected movie(s) and dates. Movie Of The Week is not, available at any HOYTS LUX session. Online booking fees, 3D, Xtremescreen, DBOX and ONYX surcharges will apply per ticket. From 12/03/2024 Movie of the Week tickets will be $12 per ticket plus applicable charges.

 

  • Benefits for Members Aged 60 Years or Older

Members aged 60 years or older and who have updated their date of birth details in the My Rewards account, will be eligible to receive exclusive Benefits as listed below. Each Benefit is limited to two (2) redemptions per member per day unless otherwise stated. Benefits are not available at HOYTS LUX, during school holidays or public holidays.

 

  • Discounted Movie Tickets: Available for all movie sessions commencing prior to 5pm in mainstream cinema. Maximum of two (2) tickets per session per day. Benefit is not available for movie sessions at HOYTS LUX. Price excludes online booking fee(s) or surcharges. From 12/03/2024, 60+ tickets will be $10 for VIP members and $11.50 for members on the free tier, plus applicable charges.

 

  • $4 Choc Tops: Available everyday if purchased before 5pm. Maximum of two (2) $4 Choc Tops per day. Choc Top flavours and availability may vary between locations.

 

  • $6 Choc Top & 600ml bottle water combo: Available everyday if purchased before 5pm. Maximum of two (2) $6 Choc Top water combos per day. Choc Top flavours and availability may vary between locations.

 

  • Special Event Member Pricing

Members wishing to attend a special event such as a HOYTS Girls Night Out or a Prams At The Pix special event screening will be able to access a discounted event ticket when a HOYTS Rewards membership number is included in the transaction.

 

  • HOYTS Points

Members will earn HOYTS Points (Points) for each dollar they spend at a HOYTS Cinema when their HOYTS Rewards Membership is included in the transaction. The number of points earned is calculated as follows:

  • HOYTS Rewards Member tier – 25 Points per $1 spent.
  • HOYTS Rewards VIP tier – 50 Points per $1 spent,

 Points are not earned on movie vouchers, complimentary tickets or free tickets.

 

  • Qantas Frequent Flyer

Members who have linked their Qantas Frequent Flyer account to their HOYTS Rewards Membership My Rewards will earn Qantas Points on eligible transactions at HOYTS. See clause 11 for more details.

10. HOYTS Points Earn and Redemption

Members will earn HOYTS Points (Points) on every dollar spent at HOYTS when their HOYTS Rewards Membership Card number is included in the transaction. The number of Points received will be based upon the dollar amount spent. The number of points earned is calculated as follows:

  • HOYTS Rewards Member tier – 25 Points per $1 spent
  • HOYTS Rewards VIP tier – 50 Points per $1 spent

 

Points can only be used with an active membership. Points are redeemable for a maximum of 24 months from the date they were earned. After 24 months, unused Points will expire and be removed from the Members account. Expired Points cannot be redeemed or reclaimed and are forfeited by the member.

Points are not earned on movie vouchers, free tickets, or complimentary tickets. Points are earned based on the total amount spent including cents and rounded to the closest Point e.g., $25.50 spend would equal 638 Points on the Member Tier and 1,275 Points on the VIP tier.

Information is correct as of 13 May 2021. HOYTS Reserves the right to change the number of Points earned per dollar spent at any time. HOYTS will make every attempt to provide notice to Members via email communication of any changes.

HOYTS Points are earned when at least one Member number is included in the transaction. If multiple Membership cards are included, each Member will receive an equal share of the Points earned. HOYTS Points can only be earned once per HOYTS Rewards Membership and cannot be duplicated across multiple memberships.

To earn Points, you must be a member at the time of transaction, have presented or included your Membership card number or be signed in when making a purchase at a HOYTS Cinema, online or via the HOYTS App. If you are not able to supply your Membership number at the time of a purchase at a HOYTS Cinema, you can supply personal details along with valid photo identification such as a driver’s license to a HOYTS crewmember who will use reasonable endeavours to locate Membership details. If Membership details cannot be located, no Benefits will be earned or applied.

Benefits will not be earned or applied if a Member does not present their personal valid HOYTS Rewards Membership card or supply their unique HOYTS Rewards Membership Number before the completion of the purchase or transaction. It is the Members’ responsibility to remember to present their HOYTS Rewards Membership card or supply their unique HOYTS Rewards Account Number. HOYTS is in no way responsible or liable if Members do not do so before the completion of the transaction. HOYTS Points cannot be earned on Corporate or Group Bookings. Any unauthorised reproduction of a HOYTS Rewards Membership card may lead to a deduction of or loss of all HOYTS Points, exclusion from the Program and may be reported to police.

HOYTS, and its respective officers, agents, employees, and related bodies corporate may refuse to record or honour Benefits in a Member’s Account, or if already recorded, may cancel such Benefits, if HOYTS cannot confirm that the HOYTS Points were properly issued or obtained. If a Member believes that any Account statement of Benefits in their Account is in error, Members must contact HOYTS Guest Experience team within 14 days from the date the Points were earned. HOYTS may require that Members submit documentation to support each claim. HOYTS’ decision on all matters relating to a HOYTS Rewards Benefit is final.

HOYTS Points may be redeemed for movie tickets, selected food, and beverage items at Participating Cinemas, as well as other rewards that HOYTS may make available from time to time. Refer table 10.1 for a list of items that Points can be redeemed forMembers must have enough Points for the selected item and cannot use Points to partially pay for an item unless stated in a separate promotional offer e.g., use of points to claim $1 and $8 movie tickets or for a specific points usage offer. Points can only be redeemed if the required redemption level is acquired prior to the redemption transaction. Points cannot be redeemed on the same day in which they were earned. A Member’s Points balance will be reduced by the number of Points redeemed.

Members may be required to provide proof of and/or authentication of their identity when redeeming HOYTS Points to protect the integrity of their Account and to verify their member status. In the event you do not have proof of identity, Members may not be allowed to redeem HOYTS Points. A Member may not sell, exchange, give, charge, or otherwise dispose of any HOYTS Points. HOYTS Points cannot under any circumstances form the basis of a monetary claim against HOYTS, cannot be converted to cash or transferred to other Members.

 

11. Qantas Frequent Flyer

 

  • Eligibility to Earn Qantas Points with HOYTS

You are eligible to earn Qantas Points on eligible purchases with HOYTS, if you are:

  • An individual; and
  • A Qantas Frequent Flyer member; and 
  • A member of the HOYTS Rewards Program. 

 

  • Earning Qantas Points with HOYTS

You will earn Qantas Points in accordance with your current Membership Tier:

  • HOYTS Rewards Member Tier - earn 1 Qantas Point per AU$2 spent on eligible purchases up to a maximum of 400 points per transaction.

 

  • HOYTS Rewards VIP Tier - earn 2 Qantas Points per AU$1 spent on eligible purchases up to a maximum of 800 points per transaction.

 

Qantas Points may take up to 45 Days after the eligible purchase to be credited to a member’s QFF Account. You will only earn Qantas Points with HOYTS if you’ve linked a valid QFF number to your HOYTS Rewards Membership profile before payment. 

Eligible purchases exclude: Gift cards or vouchers; HOYTS Rewards annual fees or Membership fees; and corporate bookings and events, and any other bulk sales or purchases through HOYTS Corporate Sales teams.

 

  • Bonus Qantas Points on Linking

Bonus Qantas Points are available to all HOYTS Rewards Members who link a valid Qantas Frequent Flyer to the HOYTS Rewards Membership for the first time on or after the 13 May 2021. HOYTS Rewards members with an existing Qantas Frequent Flyer account linked to their HOYTS Rewards membership or who unlink and relink a Qantas Frequent Flyer membership with their HOYTS Rewards membership are not eligible to earn bonus Qantas Points. Eligible members will receive an allocation of bonus Qantas Points within 45 Days after the accounts are linked. 

 

  • How to Track Your Qantas Points

You can check the Qantas Points that you have earned through HOYTS Rewards and your total points balance by logging in to your account on qantas.com. 

 

  • Eligibility to redeem Qantas Points with HOYTS

You are eligible to redeem Qantas Points for eligible purchases with HOYTS, if you are:

  • An individual; and
  • A member of the QFFP
  • An ‘Eligible Redeemer’

 

  • Redeeming Qantas Points

In addition to these terms and conditions, all Qantas Points redemption are subject to the Qantas Frequent Flyer terms and conditions located at qantas.com/terms. 

  • Qantas Points cannot be redeemed at the Candy Bar or Box Office.
  • Qantas Points can be redeemed for eligible products via the HOYTS Website, HOYTS App or via the HOYTS Kiosk located in cinema.

An eligible redeemer may redeem a minimum of 4,000 Qantas Points for eligible purchases with HOYTS reducing the total amount paid by a minimum of AU$20 or the total value of the transaction when points allow. Eligible redeemers may also redeem 3,000 Qantas Points towards the HOYTS Rewards VIP Membership cost of $15 per year.

 

  • Reversing Qantas Points

HOYTS may request Qantas to reverse (debit) any Qantas Points that have been or are to be credited to a QFF Account where there are grounds which HOYTS consider reasonable to warrant a reversal. 

 

  • Bonus Qantas Points

From time to time, HOYTS may make bonus Qantas Points offers. Separate terms and conditions may apply to these offers (in addition to these Terms and Conditions).

 

  • Claiming Qantas Points

Qantas Points will only be earned on eligible purchases that occur once your Qantas Frequent Flyer Membership number has been linked to your HOYTS Rewards Membership profile before payment.

 

  • The Qantas Frequent Flyer Program

QFF Membership is determined by Qantas not HOYTS. QFF Membership, Qantas Points (including redeeming and expiry of Qantas Points following the points being credited to your QFFP Account), the number of Qantas Points required for Rewards and changes to the number of Qantas Points required for Rewards are all subject to the QFF terms and conditions. 

 

  • Claims and Complaints

If you notify HOYTS your QFFP Account has not been appropriately credited with points to which you believe you are entitled in accordance with these and the QFF Terms and Conditions (a "Claim"), then HOYTS will, within a maximum of 30 business days after receiving your Claim, advise you whether: 

  • You are not entitled to Qantas Points under these Terms and Conditions; or 

 

  • You are entitled to Qantas Points under these Terms and Conditions, in which case HOYTS will then request Qantas to credit your QFF Account with those Qantas Points. Please allow up to 60 days after the day you are notified of this decision for your Qantas Points to be credited to your QFF Account.

12. Competitions

HOYTS may also from time to time make available to Member’s promotions and competitions (collectively, “Competitions”). Where applicable, Members may enter Competitions by meeting the entry criteria specified on each Competition. We may publish names of winners of Competition prizes.

Each Competition will be subject to any individual terms and conditions specified on the Website. However, some of the standard terms and conditions are as follows:

  • Awards and prizes must be taken intact as offered and are not transferable, exchange able or redeemable for cash;
  • If a person otherwise entitled to an award or prize is under the age 18, we reserve the right to instead give the award or prize to that person’s parent or guardian; and
  • If an award or prize is unavailable for any reason, we reserve the right to substitute an award or prize of equal or greater value.

HOYTS’ decision on all matters relating to a Competition will be final and not subject to challenge or review, subject to compliance with applicable laws. Benefits may not be redeemed in conjunction with any other promotional offers including, but not limited to, promotional discounted ticket offers. Neither HOYTS nor our officers, agents, employees, and related bodies corporate make any representation or warranty as to the quality, suitability or merchantability of any goods or services offered or given as awards or prizes.

 

13. Returns and/or Exchanges

In the event of a refund of any purchase for which Points were allocated, Points will be deducted automatically from your Membership. The Membership Points balance will be reduced by the equivalent number of Points issued for the returned items on the original transaction. In the event of an exchange, an adjustment may be made to the Points balance reflect the value of the replacement product or service. If HOYTS is unable to deliver on a Member’s purchase through no fault of the Member, for example a film session is cancelled midway, and HOYTS issues a refund or exchange, the Member will retain their HOYTS Points associated with that transaction.

 

14. Lost, stolen, or damaged Membership cards

Lost or stolen cards should be reported immediately by notifying the HOYTS Guest Experience team. When HOYTS is made aware of a lost or stolen HOYTS Rewards Membership card, it will flag the card as lost or stolen and the associated account rendered inactive.

HOYTS is not responsible for any redemption made by a third party using lost or stolen Membership details in cinema or online. Members can collect a replacement card from a HOYTS Cinema upon paying a $2 card replacement fee. Valid photo identification will be required before a replacement card is issued. A card replacement fee will be payable for all card replacements or card re-issue requests. All Benefits that the Member was eligible to redeem, at the time HOYTS is made aware of lost or stolen card, will be applied to the replacement card.

 

15. Privacy

HOYTS and its respective officers, agents, employees, and related bodies corporate (collectively, “we” or “our”) are committed to protecting your privacy. We collect your personal information for the following purposes to:

  • Set up and administer the Program including ongoing management of Accounts, and to accurately record HOYTS Points and up-to-date HOYTS Points balances;
  • Process and issue Benefits;
  • Allow Members to participate in promotions and competitions;
  • Communicate with Members, to deliver a e-newsletters, surveys and SMS communications;
  • Understand Member needs and preferences, and to provide Members with products and services that meet their needs or interests;
  • Recommend our products and services, or the products and services of third parties we select that may be of interest to Members;
  • Provide Members with special offers and rewards from HOYTS and our sponsors and rewards partners.

HOYTS will obtain consent before using personal information for a purpose that has not been specified unless the new purpose is required by law. See the HOYTS Privacy Policy at hoyts.com.au for further details. HOYTS may share aggregated and anonymised Member data with third parties so long as that aggregated and anonymised Member data cannot be reasonably traced back to an individual. If our business is transferred to a new owner, Member personal information may be transferred to the new owner.

 

16. Changes to these Terms and Conditions

HOYTS may change these Terms and Conditions, any aspect of the Program including redemption procedures or any Benefits under the Program or the QFFP or rewards in any respect and will communicate significant changes to customers. Where HOYTS changes these Terms and Conditions, or any Benefits, an updated copy of these Terms and Conditions will be available on the HOYTS website. Members should regularly check for updates to the Terms and Conditions. HOYTS reserves the right to suspend or terminate these Terms and Conditions at any time, subject to compliance with applicable laws.

 

17. General

These Terms and Conditions constitute the entire agreement between you and HOYTS regarding your participation in the Program, your entitlement to collect and redeem HOYTS Points and your entitlement to any other Benefits of the Program and supersede all previous versions. Except as expressly contained in these Terms and Conditions, there are no conditions, representations, warranties, express or implied, statutory, or otherwise. When you deal with HOYTS or its respective officers, agents, employees, and related bodies corporate over the Internet, you consent to the formation of contractual relations through electronic communications.

 

18. HOYTS Australia Website

You must be a member of the Qantas Frequent Flyer Program to earn Qantas Points. A joining fee may apply; however, HOYTS customers can join for free hereMembership and Qantas Points are subject to the terms and conditions of the Qantas Frequent Flyer Program located at qantas.com/terms.

 

19. Privacy and Consents

HOYTS is committed to your privacy. The full details of the HOYTS privacy policy are set out here.  

HOYTS will disclose personal information to Qantas Frequent Flyer Program (QFF) and Qantas Business Rewards for the following purposes: 

  • Ensuring that you are credited with Qantas Points earned with rewards Program partners;
  • Ensuring that you can redeem Qantas Points earned with rewards Program partners;
  • To optimise the Benefits available to you under rewards Program partners; and
  • To optimise offers from rewards Program partners to purchase HOYTS products.

 

The Personal information utilised for these purposes will include First Name, Last Name, address, phone number, mobile number, and QFF Number (Qantas Frequent Flyer number only).

 

20. No Liability

The Qantas Frequent Flyer Program is operated by Qantas. Either HOYTS or Qantas may terminate HOYTS’ participation in the Qantas Frequent Flyer Program. HOYTS will have no liability for any changes to the Qantas Frequent Flyer Program or if the relationship between HOYTS and Qantas with respect to the Qantas Frequent Flyer Program is terminated. HOYTS is not liable for any action taken by Qantas with respect to the implementation of the Qantas Frequent Flyer Program (including, but not limited to, any changes to the right to redeem Points for Awards or Rewards or any refusal to issue Points to a participant). HOYTS cannot ensure that a participant will be able to redeem Points for any Awards or Rewards and expressly disclaims any liability with respect to redemption.

 

Appendix A

HOYTS Fair Go Policy

1. Fair Go Policy

The purpose of our Fair Go Policy is to ensure that all our Members:

  • Can access our services and Benefits; and
  • Do not use our services or Benefits in a manner that we consider 'unreasonable' or 'unacceptable'.

 

In addition, the Fair Go Policy sets out your responsibilities when you use our services and Benefits and confirms the steps, we may take to monitor compliance with this policy. The Fair Go Policy applies to all our services and Benefits.

 

2. General

If you are a HOYTS Rewards member you may not use the service or Benefit in a manner which is 'unreasonable' or 'unacceptable'.

 

3. Unreasonable Use

We consider your use of the service or Benefit unreasonable if you use it in a manner which is other than it was intended for. Examples of uses which we consider 'unreasonable' include if you:

  • Refill your popcorn container an excessive number of times within a 12-hour period
  • Are using the service / Benefit for fraudulent purposes
  • Have abnormal or excessive use of the services / Benefits
  • Are using the Benefits for more than personal use

 

4. Unacceptable use

You may not use our services or Benefits in any manner which improperly interferes with another person's use of our services or Benefits or for illegal or unlawful purposes. Examples of uses which we consider 'unacceptable' include:

  • If you provide us with false user information to use the service
  • Contravening any applicable laws when you use the service
  • Infringing any person's intellectual property rights, including copyright, when you use the service
  • If you are using the Benefits for more than personal use

 

5. Monitoring Compliance

We may from time to time monitor your use of our services and Benefits to ensure you are complying with the terms of this policy.  We may need to disclose any findings as required to regulatory authorities.

 

6. Breach of the Fair Go Policy

If you breach any part of this Fair Go Policy, we will contact you and, if appropriate, ask you to modify your use of the service and / or Benefit. If you do not modify your use of the service and or Benefit, we may suspend or cancel your service to you. We reserve the right to suspend or cancel your Membership immediately and without any compensation or refund of fees, subject to your rights under Australian Consumer Law.
