Uber One Terms & Conditions

Ticketing Terms and Conditions

  1. Eligible Uber One members within Australia and New Zealand may purchase discounted HOYTS tickets subject to standard seats in eligible sessions at HOYTS cinemas in Australia and New Zealand, including HOYTS LUX.
  2. Standard tickets are price at the following:
    1. $12.50 for sessions
    2. Additional surcharges shall apply for premium sessions including Xtremescreen, DBOX, ONYX and 3D.
  3. HOYTS LUX tickets are priced at the following:
    1. $27.50 for sessions
    2. Additional surcharges shall apply for premium sessions including 3D.
  4. Limit of one transaction per member per day.
  5. Limit of six discounted Tickets per transaction.
  6. Tickets purchased using the Uber HOYTS ticket offer are subject to the Hoyts Terms of use available to view here
  7. Tickets are for Uber One Members' personal use and may not be re-sold, transferred, used for commercial purposes or otherwise provided to a third party.
    • Tickets purchased in excess of the daily limit or sold or used in breach of these terms and conditions may be cancelled without a refund, subject to Australian Consumer Law, and the ticketholder may be refused admission.
    • Where Uber reasonably believes that an Uber One member has abused the offer or has otherwise breached these Terms and Conditions, Uber may remove the Uber One member’s eligibility for the offer for the remainder of the promotional period.
  8. Uber One members must login to the Uber Eats app to claim the offer where they will be redirected to the HOYTS Offer ticketing landing page. To claim the offer, Uber One members must:
    • Access the link via the available method to validate they are an Uber One member, then follow the link to the Uber and HOYTS Offer ticketing landing page and purchase their Tickets online following the instructions.
    • Purchases made via hoyts.com.au may attract a booking fee. However, purchases from inside a participating cinema shall not attract a booking fee, subject to the eligible employs entering the ‘In Cinema Code’ displayed on the session time screens.
  9. Advertised pricing reflects standard seating in standard sessions. Surcharges shall apply for premium experiences including 3D, Xtremescreen, HOYTS DBOX, HOYTS ONYX. Additionally 3D glasses, where required, are not included in ticket price and must be purchased separately.
  10. Tickets purchased using the offer will not be replaced or refunded if lost, stolen or damaged and cannot be cancelled, exchanged or redeemed for cash (unless required by law).
  11. Tickets are valid for the selected movie and session only. Film classifications apply to all sessions at HOYTS. Refer to the advertised film classification to ensure that you and your guests meet the entry requirements for your film.
  12. Pricing of HOYTS Tickets, including any fees or surcharges listed in these Terms and Conditions are subject to change.
  13. This offer and the associated conditions may be extended, changed or retracted.

 

Popcorn Refill Terms and Conditions

  • Eligible Customers are entitled to receive free popcorn refills on the same day as a popcorn is purchased either as part of a combo or as a standalone item and when a valid Uber One membership status has been presented on their Uber Eats app aspart of the original purchase and the same membership status is presented as part of the free refill.
  • To receive this benefit, Eligible Customers need to return their empty popcorn container to a team member at the candy bar point of sale and requesta popcorn refill from a team member at the counter and display their Uber One membership status on their Uber Eats app. HOYTS will replace the empty popcorn container with a full one of a similar or same size.
  • Free popcorn refills not available forHOYTS Gourmet Popcorn Range.
  • Eligible Customers will not be required to return promotional containers but will need to present the promotional container when requesting the free refill.
  • The refill will be supplied in a standard container of same / similar size and this container willneed to be used for any additional refills on that day.
  • Eligible Customers will not be supplied with another promotional container as part of this offer.
  • Used popcorn containers must be returned to HOYTS Staff when this benefit is being redeemed.
  • Popcorn refills are provided under the HOYTS Fair Go policy where HOYTS reserves the right in its sole discretion to refuse to refill an Eligible Customer’s popcorn where it is believed the benefit / offer is being abused and / or the refills are not for personal use or are being unreasonably shared with other groups / people.
  • Free popcorn refills must be redeemed no later than 30 minutes after the last session of the day has commenced, where the offer is being redeemed.
  • HOYTS reserves the right not to provide free popcorn refills after this time.

 

Appendix A

Uber x HOYTS Fair Go Policy

1. Uber x HOYTS Fair Go Policy

The purpose of the Uber x HOYTS Fair Go Policy is to ensure that all Uber One Members:

  • Can access our services and Benefits; and

  • Do not use our services or Benefits in a manner that we consider 'unreasonable' or 'unacceptable'.

In addition, the Uber x HOYTS Fair Go Policy sets out your responsibilities when you use our services and Benefits and confirms the steps, we may take to monitor compliance with this policy. The Uber x HOYTS Fair Go Policy applies to all our services and Benefits.

2. General

If you are an Uber One member you may not use the service or Benefit in a manner which is 'unreasonable' or 'unacceptable'.

3. Unreasonable Use

We consider your use of the service or Benefit unreasonable if you use it in a manner which is other than it was intended for. Examples of uses which we consider 'unreasonable' include if you:

  • Refill your popcorn container an excessive number of times within a 12-hour period

  • Are using the service / Benefit for fraudulent purposes

  • Have abnormal or excessive use of the services / Benefits

  • Are using the Benefits for more than personal use

4. Unacceptable use

You may not use our services or Benefits in any manner which improperly interferes with another person's use of our services or Benefits or for illegal or unlawful purposes. Examples of uses which we consider 'unacceptable' include:

  • If you provide us with false user information to use the service

  • Contravening any applicable laws when you use the service

  • Infringing any person's intellectual property rights, including copyright, when you use the service

  • If you are using the Benefits for more than personal use

5. Monitoring Compliance

We may from time to time monitor your use of our services and Benefits to ensure you are complying with the terms of this policy.  We may need to disclose any findings as required to regulatory authorities.

6. Breach of the Uber x HOYTS Fair Go Policy

If you breach any part of this Uber x HOYTS Fair Go Policy, we may contact you and, if appropriate, ask you to modify your use of the service and / or Benefit. If you do not modify your use of the service and or Benefit, we may suspend or cancel our service to you, subject to your rights under Australian Consumer Law.
